CEDAR BLUFF PLANNING COMMISSION MINUTES
JANUARY 2, 2007 AT 5:00 P.M.
The Cedar Bluff Planning Commission met in regular session in the Council Room at Town Hall, 3420 Spring Street, Cedar Bluff, Alabama, Monday, January 2, 2007 at 5:00 p.m., pursuant to notice duly posted as prescribed by law. Chairman Herb Sherwin presided and called the meeting to order. Members in attendance were as follows:

Also present was Zoning Enforcement Officer Jimmy Wallace.
Item No. 1: Call to Order
The meeting was called to order by Chairman Herb Sherwin.
Item No. 2: Approve minutes of the December 4, 2006 meeting
A motion was made by W K Summers, seconded by Leatha Harp, that the minutes be approved as presented. Motion carried (7-0).
Item No. 3: Public hearing and consider amending Zoning Ordinance, Section 7.2 and 8.2 as follows:
Amend Section 7.2, R-2 Medium Density Residential Zoning District, (D) to allow campers and recreational vehicles (only if lot does not have enough area above Alabama power Flood Easement line to build a house on). Rules and Regulations of the LR Lakefront Recreational Zone will apply.
Amend Section 8.2, (A). R-3, High Density Residential Zoning District, all uses permitted in R-2, Medium Density Residential Zoning District, except 7.2 D, recreation vehicles.
Chairman Sherwin declared a public hearing open to discuss amendments to the Zoning Ordinance.
After much discussion to clarify the intention of this amendment is to discourage campers where there is enough space to build a home, a motion was made by Jerry Holt, seconded by Billy Harris, to make recommendation to the Town Council to amend the Zoning Ordinance Article 5, Section 7.2, R-2 Medium Density Residential Zoning District, (D) to allow campers and recreational vehicles (only if lot does not have enough area above Alabama Power Flood Easement line to build a house on). Rules and Regulations of the LR Lakefront Recreational Zone will apply. Motion carried (7-0).
Chairman Sherwin declared a public hearing open to discuss amendments to the Zoning Ordinance.
A motion was made by Jerry Holt, seconded by Billy Harris, to revise the wording on this item and make recommendation to the Town Council to amend the Zoning Ordinance Article V, Section 8.2 (A), R-3 High Density Residential Zoning District; all uses permitted in R-2, Medium Density Residential Zoning District, except 72D. Motion carried (7-0).
Item No. 4: Old Business.
There was no Old Business to be discussed.
Item No. 5: New Business
In New Business, Zoning Enforcement Official Jimmy Wallace requested the Commission research and consider amending the zoning code to allow temporary mobile or modular office buildings in LM, Light Manufacturing; NB, Neighborhood Business; and HC, Highway Commercial Districts.
A motion was made by W K Summers, seconded by DeLana Martin, to post a notice for a public hearing to consider amending the zoning code to allow temporary mobile or modular office buildings in LM, Light Manufacturing District; NB, Neighborhood Business District; and HC, Highway Commercial District not to exceed two (2) years unless probable cause can be shown. Motion carried (7-0).
Mr. Wallace also suggested that the procedures for a variance be discussed at a later meeting. Chairman Sherwin advised that this item should be on the next agenda for discussion.
Item No. 7: Adjournment
There being no further business to come before the meeting, a motion was made by DeLana Martin, seconded by Leatha Harp, that the meeting be adjourned (5:41 p. m). Motion carried (7-0).
