CEDAR BLUFF PLANNING COMMISSION MINUTES
FEBRUARY 5, 2007 AT 5:00 P.M.
The Cedar Bluff Planning Commission met in regular session in the Council Room at Town Hall, 3420 Spring Street, Cedar Bluff, Alabama, Monday, February 5, 2007 at 5:00 p.m., pursuant to notice duly posted as prescribed by law. Chairman Herb Sherwin presided and called the meeting to order. Members in attendance were as follows:

Also present was Zoning Enforcement Officer Jimmy Wallace.
Item No. 1: Call to Order
The meeting was called to order by Chairman Herb Sherwin.
Item No. 2: Approve minutes of the January 2, 2007 meeting
A motion was made by W K Summers, seconded by Billy Harris, that the minutes be approved as presented. Motion carried (6-0).
At this time Chairman Sherwin deviated from the regular agenda to advise the Commission he had been approached by a citizen who is considering rezoning property due to high taxes.
After a discussion about the possibility of a rezoning request being submitted, the Commission came to the conclusion not to set such precedence.
Item No. 3: Public

No persons appeared and the public hearing was closed.
A motion was made by Harlan Starr, seconded by W K Summers, to make recommendation to the Town Council to rezone property located at 8160 Alabama Highway 9 North from “”RR” Rural Residential Zoning District to “HC”, Highway Commercial Zoning District for use as a mercantile. Motion carried (6-0).
Item No. 4: Public hearing and consider amending Zoning Ordinance, Article V as follows:
Chairman Sherwin declared a public hearing open to discuss amendments to the Zoning Ordinance.
After a discussion of changes, a motion was made by Harlan Starr, seconded by DeLana Martin, to make recommendation to the Town Council to amend the Zoning Ordinance Article 5, as follows:
· Amend Article V, Section 10, NB, Neighborhood Business Zoning District to allow temporary mobile or modular office buildings for a term not to exceed two (2) years unless probable cause can be shown
· Amend Article V, Section 11, HC, Highway Commercial Zoning District to allow temporary mobile or modular office buildings for a term not to exceed two (2) years unless probable cause can be shown
· Amend Article V, Section 12, LM Light Manufacturing Zoning District to allow temporary mobile or modular office buildings for a term not to exceed two (2) years unless probable cause can be shown
Motion carried (6-0).
Item No. 4: Old Business.
There was no Old Business to be discussed.
Item No. 5: New Business
In New Business, DeLana Martin, advised the Commission she had been approached by a sign contractor questioning the reason no Billboard signs were allowed in Cedar Bluff.
Zoning Enforcement Official Jimmy Wallace also questioned some of the restrictions on various types of signs. The Commission advised that this issue had arisen earlier and when it was discussed by the Town Council a decision was made not to allow billboards because Cedar Bluff didn’t need signs lining Highway 9.

There being no further business to come before the meeting, a motion was made by W K Summers, seconded by DeLana Martin, that the meeting be adjourned (5:56 p. m). Motion carried (6-0).
