CEDAR BLUFF TOWN COUNCIL MEETING

MONDAY, JUNE 12, 2006 AT 4:00 P.M.

 

The Cedar Bluff Town Council of the Town of Cedar Bluff, County of Cherokee, State of Alabama, met in Regular Scheduled Session in the Council Room at Town Hall, 3420 Spring Street, Cedar Bluff, Alabama, Monday, June 12, 2006 at 4:00 p.m., pursuant to notice duly posted as prescribed by law. Mayor Martha Baker presided and called the meeting to order.  Members in attendance were as follows:

      The invocation was given by Council member Leatha Harp.

AGENDA ITEM NO. 1:                    Consider approval of the minutes of the May 8, 2006 meeting.

 

            A motion was made by Council Member Sides, seconded by Council Member Harp that the minutes of May 8, 2006, be approved as presented.  Motion carried (6-0).

AGENDA ITEM NO. 2:                    Acknowledge minutes of the Planning Commission minutes of May 1, 2006

 

            The Planning Commission minutes of May 1, 2006 were acknowledged.

           

AGENDA ITEM NO 3:                     Presentation of Police Report for May 2006 by Police Chief Walden.

 

      The Police report was given by Police Chief Walden.

     

AGENDA ITEM NO. 4:                    Presentation of Fire Department Report for May, 2006 by Fire Chief J. P. Curry.

 

            There was no Fire report given.

 

AGENDA ITEM NO. 5:                    Presentation of Code Enforcement Report for May, 2006 by Code Enforcement Officer Jimmy Wallace.

 

            The Code Enforcement report was given by Code Enforcement Officer Jimmy Wallace.

 

AGENDA ITEM NO. 6:                    Consider a resolution establishing guidelines for wrecker rotation by the Town of Cedar Bluff.

 

            A motion was made by Council Member Sprouse, seconded by Council Member Burkhalter, to adopt a resolution establishing guidelines for wrecker rotation by the Town of Cedar Bluff.  Motion carried (6-0).

            Mayor Baker now declared Resolution No. 2006-05 duly passed and adopted.

 

AGENDA ITEM NO. 7:                    Consider rescinding the animal ordinance for the Town of Cedar Bluff.

 

            Mayor Baker advised the town did not have the employees or the funds to enforce the animal ordinance as it is written now and the ordinance needs to be rescinded at this time.  A motion was made by Council Member Burkhalter, seconded by Council Member Sprouse, to rescind the animal “dog” ordinance.  Motion carried (5-0).

COUNCIL MEMBER SIDES OUT OF ROOM

 

            The decision to rescind the ordinance brought numerous objections from the several citizens of the town about the dangers of walking in neighborhoods with dogs running loose.

Mr. Bob Kastl, Mrs. Marcia Kastl and Mrs. Ann Carr brought several incidents to the Council’s attention.

After a lengthy discussion, the Council decided to work on another ordinance that would be enforceable, possibly imposing fines on violators.

 

AGENDA ITEM NO. 8:                    Consider recommendations from the Planning Commission to have a public hearing and consider an ordinance to change Article V, Section 11.2, to permit residential structures in the HC; Highway Commercial Zoning District.

 

            A motion was made by Council Member Sprouse, seconded by Council Member Burkhalter, to accept the recommendations from the Planning Commission and advertise for public hearing and consider ordinance to changed Article V, Section 11.2, to permit residential structures in the HC; Highway Commercial Zoning District.  Motion carried (5-0).

AGENDA ITEM NO. 9:                    Consider recommendations from the Planning Commission to have a public hearing and consider an ordinance to change the following:

 

·         Article V, Section 5.3 (RR District), Paragraph E, Maximum Structure Height from Thirty-five (35) feet for all structures that are not exempt from height requirements, as specified in Article III, Section 3.1 of this Ordinance to Fifty (50) feet.

·         Article V, Section 6.3 (R-1 District), Paragraph E, Maximum Structure Height from Thirty-five (35) feet for all structures that are not exempt from height requirements, as specified in Article III, Section 3.1 of this Ordinance to Fifty (50) feet.

·         Article V, Section 7.3 (R-2) District), Paragraph E, Maximum Structure Height from Thirty-five (35) feet for all structures that are not exempt from height requirements, as specified in Article III, Section 3.1 of this Ordinance to Fifty (50) feet.

 

A motion was made by Council Member Sprouse, seconded by Council Member Burkhalter, to accept the recommendations from the Planning Commission and advertise for a public hearing and consider an ordinance to consider the following:

AGENDA ITEM NO. 10:                  Consider allowing Mr. Ben Marcus, Vulcan Communication for Cherokee County Chamber of Commerce to advertise Cedar Bluff in the map.

 

            Mr. Ben Marcus, Vulcan Communication appeared before the council to show the map that would be displayed at the welcome centers and at the boat shows this year and to advise the cost of the map would be $750.50 for Cedar Bluff to be advertised in the map through the Chamber of Commerce.

            A motion was made by Council Member Sprouse, seconded by Council Member Pearson, to authorize the town to participate in this advertisement.  Motion carried (5-0)

AGENDA ITEM NO. 11:                  Consider amending the Policy and Procedures manual Section 9.4.2.3 (accrual of vacation leave).

 

            Mayor Baker advised that the only amendment being made to the Policy and Procedures manual was the accrual of vacation leave and that really only affected the personnel that had been employed over ten (10) years.

 

            A motion was made by Council Member Sprouse, seconded by Council Member Burkhalter, that the Policy and Procedures Manual be amended as presented.  Motion carried (5-0).

AGENDA ITEM NO. 12:                  Consider payment for mosquito spraying by town employees.

 

            Mayor Baker advised that Council Member Sprouse would explain the procedure for mosquito spraying this season.  Mrs. Sprouse recommended that the Utility Board would purchase the chemicals and the equipment for the spraying and the Town pay for the labor to spray the mosquitoes and at the end of the season the Town and the Utility Board split the cost.

 

            A motion was made by Council Member Sprouse, seconded Council Member Burkhalter, to accept the recommendation that the Utility Board would purchase the chemicals and the equipment for the spraying and the Town pay for the labor as straight time to spray the mosquitoes and at the end of the season the Town and the Utility Board split the cost.  Motion carried (6-0)

AGENDA ITEM NO. 13:                  Consider implementing a beautification committee.

 

            A motion was made by Council Member Sprouse, seconded by Council Member Pearson, to implement a beautification committee for the Town of Cedar Bluff.  Motion carried (6-0).

AGENDA ITEM 14:                          Consider authorizing Police Chief Steve Walden to purchase an Eagle Eye Digital Video Recorder, a 2 camera system with compact flash card with seizure money at a cost of $4,195.00.

 

            A motion was made by Council Member Pearson, seconded by Council Member Sides, to authorize Police Chief Walden to purchase an Eagle Eye Digital Video Recorder, a 2 camera system with compact flash card at a cost of $4,195.0 with monies received from seized vehicles.  Motion carried (6-0)

AGENDA ITEM NO. 15:                  Consider increasing Permit Fee Schedule to read as follows:

           

C. Mechanical Permit Fee Schedule

$40.00 for the first unit, plus $20.00 for each additional unit

 

Fire Sprinkler System                          $150.00

 

Elevator                                               $150.00

Commercial Sewer Pump Stations      $150.00

 

E. Swimming Pool Permit Fee Schedule

 

For each public swimming pool          $100.00

 

A motion was made by Council Member Sprouse, seconded by Council Member Sides, to increase the permit fee schedule as presented.  Motion carried (6-0).

AGENDA ITEM NO. 16:                  Consider authorizing the Mayor to spend up to $1,000.00 on traffic signs (town limits, police jurisdiction, building & zoning, police department, and municipal offices, no littering) for the Town.

 

            A motion was made by Council Member Sprouse, seconded Council Member Sides, to authorize the Mayor to spend up to $1,000.00 to purchase traffic signs for the Town (town limits, police jurisdiction, building & zoning, police department, municipal offices, no littering).  Motion carried (6-0).

AGENDA ITEM NO. 17:                  New Business (Any matter not known about or which could not have been reasonably foreseen prior to the posting of the agenda)

 

            In New Business, Council Member Sides advised he was still working with the police department and checking on prices for purchasing or leasing police vehicles.

 

AGENDA ITEM NO NO 18:            Citizen’s Participation (A five minute limit per person)

 

            Under Citizen’s Participation, Ann Carr asked how long the alcohol lawsuit in Cedar Bluff would be continuing.  Mayor Baker advised we had no idea.  The attorney’s kept us informed as to the status of the case.

 

            Mr. Larry Rogers, Larry’s Towing inquired about when the rules and regulations for the towing would be ready.

            There being no further business to be considered, a motion was made by Council Member Sprouse, seconded by Council Member Burkhalter, that the meeting be adjourned.  Motion carried 6-0).
