CEDAR BLUFF PLANNING COMMISSION MINUTES
AUGUST 7, 2006 AT 5:00 P.M.
The Cedar Bluff Planning Commission met in regular session in the Council Room at Town Hall, 3420 Spring Street, Cedar Bluff, Alabama, Monday, August 7, 2006 at 5:00 p.m., pursuant to notice duly posted as prescribed by law. Chairman Herb Sherwin presided and called the meeting to order. Members in attendance were as follows:

Also present was Zoning Enforcement Officer Jimmy Wallace and several town citizens.
Item No. 1: Call to Order
The meeting was called to order by Chairman Herb Sherwin.
Item No. 2: Approve minutes of the July 3, 2006 meeting
A motion was made by W. K. Summers, seconded by Billie Harris, that the minutes be approved as presented. Motion carried (7-0).
Item No. 3: Public hearing to consider the following:
a. Change the initial zoning of annexed property to
the best suited use for the location
b. Increase rezoning fee
c.
Rezone the property in the middle section
of
Chairman Herb Sherwin declared a public hearing in session to consider the following items:
a. change the initial zoning of annexed property to the best suited use for the location.
Code Enforcement Officer Jimmy Wallace advised that due to Section 7.72 of the zoning code app annexed property is automatically in the RR; Rural Residential when it annexed. Therefore this item cannot be considered at this time.
b. Increase rezoning fee
No persons appeared and the public hearing was closed.
A motion was made by W K Summers, seconded by Harlan Starr, to make recommendation to the Town Council to increase the rezoning fee from $25.00 to $100.00. Motion carried (7-0).

Chairman Herb Sherwin declared a public hearing in session to consider rezoning property located at 2290 HWY 68E, from “RR” Rural Residential Zoning District to “HC”, Highway Commercial Zoning District for use as a restaurant and motel.
No persons appeared and the public hearing was closed.
A motion was made by W K Summers, seconded by Leatha Harp, to make recommendation to the Town Council to rezone property located at 2290 HWY 68E, from “RR” Rural Residential Zoning District to “HC”, Highway Commercial Zoning District for use as a restaurant and motel. Motion carried (7-0).
Item No. 5: Public hearing to consider rezoning property located on AL Highway 68 from “RR” Rural Residential Zoning District to “HC”, Highway Commercial Zoning District for use as a store and mini storage (Applicant: William T. Harton)
Chairman Herb Sherwin declared a public hearing in session to consider rezoning property located on AL Highway 68 from “RR” Rural Residential Zoning District to “HC”, Highway Commercial Zoning District for use as a store and mini storage.
No persons appeared and the public hearing was closed.
A motion was made by Harlan Starr, seconded by W K Summers, to make recommendation to the Town Council to property located on AL Highway 68 from “RR” Rural Residential Zoning District to “HC”, Highway Commercial Zoning District for use as a store and mini storage. Motion carried (7-0).
Item No. 6: Public hearing to consider rezoning property located on AL Hwy 68 from“RR” Rural Residential Zoning District to “R-3”, High Density Residential Zoning District. (Applicant: W K & Ruth Summers)
Chairman Herb Sherwin declared a public hearing in session to consider rezoning property located on AL Highway 68 from “RR” Rural Residential Zoning District to “R-3”, High Density Residential Zoning District.
No persons appeared and the public hearing was closed.
A motion was made by DeLana Martin, seconded by Leatha Harp, to make recommendation to the Town Council to rezone property located on AL Highway 68 from “RR” Rural Residential Zoning District to “R-3”, High Density Residential Zoning District. Motion carried (6-0).

hearing to consider rezoning property located on County Road 131 from “RR”
Rural Residential Zoning District to “HC” Highway Commercial Zoning District
for use as a campground, store and motel. (Applicant:
Chairman Herb Sherwin declared a public hearing in session to consider rezoning property located on County Road 131 from “RR” Rural Residential Zoning District to “HC” Highway Commercial Zoning District for use as a campground, store and motel.
No persons appeared and the public hearing was closed.
Code Enforcement Officer Jimmy Wallace advised that this rezoning would include the entire campground and it would all be “HC” Highway Commercial Zoning District.
A motion was made by DeLana Martin, seconded by Leatha Harp, to make recommendation to the Town Council to rezone property located on County Road 131 from “RR” Rural Residential Zoning District to “HC” Highway Commercial Zoning District for use as a campground, store and motel. Motion carried (6-0).

Item No. 11: New Business
Mr. Chuck Richards, Riverbend Estates appeared to express his concerns with Alabama Power and the rules and regulations for building in the flood zone in Cedar Bluff. He inquired as to who rules what?
Chairman Sherwin explained that FEMA has regulations and they have the right to withhold assistance if those regulations are not adhered to.
Mayor Baker
advised that FEMA had informed the Town of
Mr. Gary James appeared to advise he had been given a permit to build by Alabama Power and now they are causing him problems.
Mayor Baker advised that Cedar Bluff can’t enforce the rules and regulations until Alabama Power allows us to.

There being no further business to come before the meeting, a motion was made by W. K Summers, seconded by Harlan Starr, that the meeting be adjourned. Motion carried (6-0).
