CEDAR BLUFF PLANNING COMMISSION MINUTES

NOVEMBER 5, 2007 AT 5:00 P.M.

 

The Cedar Bluff Planning Commission met in regular session in the Council Room at Town Hall, 3420 Spring Street, Cedar Bluff, Alabama, Monday, November 5, 2007 at 5:00 p.m., pursuant to notice duly posted as prescribed by law. Chairman Herb Sherwin presided and called the meeting to order.  Members in attendance were as follows:

Item No. 1:                                                       Call to Order

 

The meeting was called to order by Chairman Herb Sherwin.

 

Item No. 2:                                                       Approve minutes of the October 1, 2007 meeting

 

A motion was made by Jerry Holt, seconded by Leatha Harp, that the minutes be approved as presented.  Motion carried (6-0).

 

Item No. 3:                                                       Old Business.

 

In Old Business, Chairman Sherwin advised he had contacted the Alabama Manufactured Housing Commission about the requirements of where mobile homes can be located, who enforces the regulations and whether the mobile homes can be moved across state lines.  Mr. Sherwin advised he still was not clear as to who enforces the regulations, but according to state law mobile homes are not supposed to be moved across state lines to be sold.

 

Item No. 4:                                                       New Business

 

In New Business,  a discussion ensued about what zones in Cedar Bluff allowed mobile homes and R-1, Low Density Residential and R-2, Medium Density Residential Zoning District are the only two zones that currently allow mobile home. 

After a lengthy discussion, a motion was made by Jerry Holt, seconded by DeLana Martin to advertise for a public hearing to amend the current zoning ordinance to remove C (allow mobile homes in R-2, Medium Density Residential Zoning District) from Section 6.2 of Article 5.  Motion carried (6-0).

In other New Business, a motion was made by DeLana Martin, seconded by Jerry Holt, to advertise for a public hearing to rezone property located on Alabama Hwy 9, Trammel Mobile Home Park, from R-2, Medium Residential Zoning District to MHP, Manufactured Home Park Zoning District.  Motion carried (6-0)

Also discussed was the property located on County Road 92 and Alabama Hwy 9. A motion was made by Jerry Holt, seconded by Leatha Harp to advertise for a public hearing to rezone property located from the Trammel Mobile Home Park on Hwy 9 to the intersection of Hwy 9 and County Road 92 from R-2, Medium Density Residential District to HC, Highway Commercial Zoning District.  Motion carried (6-0).

A motion was also made by Jerry Holt and seconded by Leatha Harp to advertise for a public hearing to rezone the remaining R-2 section of the city limits on County Road 92 (both sides road), from R-2, Medium Density Residential Zoning District to RR, Rural Residential Zoning District.  Motion carried (6-0).

At this time, the Commission discussed amending the zoning code for location of accessory structures in residential areas.  A motion was made by Leatha Harp, seconded by Billy Harris that Article III, Section 4.1 A be amended as follows:

A.     Accessory structures shall be permitted in rear and side yard only.

Motion carried (6-0).

 

Item No. 5:                                                       Adjournment.

 

There being no further business to come before the meeting, a motion was made by Debbie Shaw, seconded by Billie Harris, that the meeting be adjourned (6:04 p. m).  Motion carried (6-0).
