CEDAR BLUFF PLANNING COMMISSION MINUTES

DECEMBER 3, 2007 AT 5:00 P.M.

 

The Cedar Bluff Planning Commission met in regular session in the Council Room at Town Hall, 3420 Spring Street, Cedar Bluff, Alabama, Monday, December 3, 2007 at 5:00 p.m., pursuant to notice duly posted as prescribed by law. Chairman Herb Sherwin presided and called the meeting to order.  Members in attendance were as follows:

Item No. 1:                                                       Call to Order

 

The meeting was called to order by Chairman Herb Sherwin.

 

Item No. 2:                                                       Approve minutes of the November 5, 2007 meeting

 

A motion was made by Jerry Holt, seconded by Leatha Harp, that the minutes be approved as presented.  Motion carried (8-0).

 

Item No. 3:                                                       Public hearing and consider rezoning certain property located at the intersection of Alabama Highway 9 and County Road 63 from RR, Rural Residential District to HC, Highway Commercial Zoning District.

 

Chairman Sherwin declared a public hearing open to consider rezoning certain property located at the intersection of Alabama Highway 9 and County Road 63 from RR, Rural Residential District to HC, Highway Commercial Zoning District.

No persons appeared and the public hearing was closed.          

After a lengthy discussion, a motion was made by DeLana Martin, seconded by Leatha Harp, to recommend to the Town Council that property located at the intersection of Alabama Highway 9 and County Road 63 be rezoned from RR, Rural Residential District to HC, Highway Commercial Zoning District.   Motion carried (8-0).

 

Item No. 4:                                                       Public hearing and consider rezoning certain property located on Alabama Highway 9 (Trammel Mobile Home Park) from “R-2” Medium Density Residential Zoning District; to “MHP” Manufactured Home Park Zoning District for its current use

 

 

Chairman Sherwin declared a public hearing open to consider rezoning certain property located on Alabama Highway 9 (Trammel Mobile Home Park) from “R-2” Medium Density Residential Zoning District; to “MHP” Manufactured Home Park Zoning District for its current use.

No persons appeared and the public hearing was closed.          

A motion was made by Harlan Starr, seconded by Billie Harris, to recommend to the Town Council that property located on Alabama Highway 9 (Trammel Mobile Home Park) be rezoned from “R-2” Medium Density Residential Zoning District; to “MHP” Manufactured Home Park Zoning District for its current use.   Motion carried (8-0).

 

Item No. 5:                                                       Public hearing and consider rezoning certain property located on Alabama Highway 9 and County Road 92 from the Trammel Mobile Home Park on Hwy 9 to the intersection of Hwy 9 and County Road 92 from R-2, Medium Density Residential District to HC, Highway Commercial Zoning District

 

Chairman Sherwin declared a public hearing open to consider rezoning certain property located Alabama Highway 9 and County Road 92 from the Trammel Mobile Home Park on Hwy 9 to the intersection of Hwy 9 and County Road 92 from R-2, Medium Density Residential District to HC, Highway Commercial Zoning District.

No persons appeared and the public hearing was closed.          

A motion was made by Jerry Holt, seconded by Harlan Starr, to recommend to the Town Council that property located on Alabama Highway 9 and County Road 92 from the Trammel Mobile Home Park on Hwy 9 to the intersection of Hwy 9 and County Road 92 from R-2, Medium Density Residential District to HC, Highway Commercial Zoning District.  Motion carried (7-1).

 

AYE:  Holt, Starr, Sherwin, Harris, Harp, Summers, Martin

NAY: None

ABSTAIN: Shaw

 

Item No. 6:                                                       Public hearing and consider rezoning the remaining R-2 section of the city limits on County Road 92 (both sides road), from R-2, Medium Density Residential Zoning District to RR, Rural Residential Zoning District

 

Chairman Sherwin declared a public hearing open to consider rezoning the remaining R-2 section of the city limits on County Road 92 (both sides road), from R-2, Medium Density Residential Zoning District to RR, Rural Residential Zoning District.

No persons appeared and the public hearing was closed.          

A motion was made by Harlan Starr, seconded by DeLana Martin, to recommend to the Town Council that the remaining R-2 section of the city limits on County Road 92 (both sides road), from R-2, Medium Density Residential Zoning District to RR, Rural Residential Zoning District.  Motion carried (7-1).

 

AYE:  Starr, Martin, Holt, Sherwin, Harris, Harp, Summers

NAY: None

ABSTAIN: Shaw

 

Item No. 7:                                                       Public hearing and consider amending the Zoning Ordinance to remove C (allow mobile homes in R-2, Medium Density Residential Zoning District) from Section 6.2 of Article V

                                                                       

Chairman Sherwin declared a public hearing open to consider amending the Zoning Ordinance to remove C from Section 6.2 of Article V and reserve for future use.

No persons appeared and the public hearing was closed.          

A motion was made by DeLana Martin, seconded by Billie Harris, to recommend to the Town Council to amend the Zoning Ordinance to remove C from Section 6.2 of Article V and reserve for future use.   Motion carried (8-0).

 

Item No. 8:                                                       Public hearing and consider amending Article III, Section 4-1, A of the Zoning Ordinance

Accessory structures shall be permitted in the rear and side yards only.

 

Chairman Sherwin declared a public hearing open to consider amending Article III, Section 4-1, A of the Zoning Ordinance

No persons appeared and the public hearing was closed.          

A motion was made by Jerry Holt, seconded by Harlan Star, to recommend to the Town Council to amend the Zoning Ordinance Article III, Section 4-1, A of the Zoning Ordinance

Accessory structures shall be permitted in the rear and side yards only.

 Motion carried (8-0).

 

Item No. 9:                                                       Consider appointment of new officers for 2008

 

A motion was made by W K Summers, seconded by Jerry Holt, to appoint the same officers for 2008; i.e.: Herb Sherwin, Chairman, Harlan Star, Vice Chairman, DeLana Martin, Secretary.  Motion carried (8-0).

 

Item No. 10:                                                     Acknowledge meeting calendar for 2008          

 

The meeting calendar for 2008 was acknowledged.

 

Item No. 11:                                                     Old Business.

 

There was no Old Business to be considered.

 

Item No. 12:                                                     New Business

 

There was no New Business to be considered.

There being no further business to come before the meeting, a motion was made by W K Summers, seconded by Jerry Holt, that the meeting be adjourned (5:35 p. m).  Motion carried (8-0).
